I. Standard Business Terms

§1 Basic Provisions

  1. The following standard business terms apply to all contracts concluded with GALACTYC BRANDS LTD. via the eu.nebularperfumes.com website. The inclusion of your own conditions is expressly excluded unless agreed otherwise in writing.
  2. In these terms, a “consumer” is any natural person entering into a legal transaction that is predominantly not related to their commercial or professional activities. A “business customer” refers to any natural or legal person or legal partnership acting in the course of their commercial or independent professional activity.

§2 Conclusion of the Contract

  1. The subject of the contract is the sale of physical products offered on our website.
  2. By placing a product on our website, you receive a binding offer from us to conclude a contract via the online shopping cart system under the conditions specified in the item description.
  3. The contract is concluded as follows:
    • Products intended for purchase are placed in the shopping cart.
    • You can review and modify the shopping cart at any time.
    • After proceeding to checkout and entering your personal, shipping, and payment information, you will receive an order overview.
    • You have the opportunity to review and correct your information before final submission.
    • By confirming the order (“Buy now”, “Order with obligation to pay” or similar), you declare your legally binding acceptance, and the contract is concluded.
  4. Contract confirmation and related communications are sent via email. You must ensure that your email address is correct and that emails from us are not blocked by SPAM filters.

§3 Payment Methods

  1. The available payment methods are displayed on the website at the time of ordering.
  2. By choosing a payment method, you agree that payment processing may involve third-party service providers such as Klarna or PayPal, and your personal data may be transmitted to them as necessary to process the payment and conduct creditworthiness checks.

§4 Retention of Title

  1. Goods remain the property of GALACTYC BRANDS LTD. until full payment of the purchase price.
  2. A right of retention can only be exercised in cases where claims arise from the same contractual relationship.

§5 Warranty and Liability

  1. Statutory warranty rights apply.
  2. Consumers are requested to promptly inspect delivered goods for completeness, visible defects, and transport damage, and notify us and the carrier in writing. Failure to do so does not affect your statutory warranty claims.
  3. Any deviation from product characteristics that has been explicitly agreed between the parties before conclusion of the contract is binding.
  4. Liability for minor negligence is excluded unless mandatory legal provisions apply.

§6 Right of Withdrawal

  1. Consumers have a statutory right of withdrawal in accordance with EU Directive 2011/83/EU and German law.
  2. The detailed withdrawal instructions are provided in the separate “Revocation Policy” section of our website.
  3. The costs of returning goods are borne by the consumer, unless otherwise stated.

§7 Delivery and Risk

  1. Unless otherwise stated, delivery times are 2–4 business days after order confirmation (or receipt of payment for prepayment orders).
  2. Delivery occurs to the addresses provided by the customer.
  3. Risk of accidental loss or deterioration of the goods passes to the consumer upon delivery. This does not apply if the consumer has chosen a carrier that was not specified by us.
  4. For deliveries outside the European Union (e.g., Switzerland), the consumer is responsible for customs duties, taxes, and other import-related charges.

§8 Choice of Law, Place of Fulfilment, and Jurisdiction

  1. German law applies for consumers in Germany, provided it does not reduce mandatory protections under the law of the customer’s country of residence.
  2. Place of fulfilment and jurisdiction for business customers is the registered office of GALACTYC BRANDS LTD.
  3. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded.

Technical steps for contract conclusion, correction options, and contract confirmation follow the rules described in §2 of these Standard Business Terms.

3. Contract Language and Saving the Contract

  1. Contract language is English.
  2. The complete text of the contract is not permanently stored on our servers. Customers can print or electronically save the contract data before finalizing the order. After confirmation, order data, statutory information, and the Standard Business Terms are sent via email.

4. Main Features of the Product

Key features of the products are described in the respective product listings on our website.

5. Prices and Payment

  1. Prices shown include all applicable taxes for EU deliveries.
  2. Shipping costs are added and displayed separately during the checkout process.
  3. For deliveries outside the EU, customs duties, taxes, and transfer fees are borne by the consumer.
  4. Payment obligations become due immediately unless otherwise stated for specific payment methods.
